Please read these terms carefully before using Medikanic

1. Acceptance of Terms

By accessing or using Medikanic's services — including our website at medikanic.com and our WhatsApp-based patient intake automation system — you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

These terms apply to both clinics (B2B clients) and patients (end users) interacting with Medikanic-powered intake flows.

2. Description of Service

Medikanic provides AI-powered WhatsApp automation software for medical tourism clinics. Our platform enables clinics to:

Medikanic is a software platform only. We are not a medical provider, healthcare facility, or licensed medical service. We do not provide medical advice, diagnosis, or treatment.

4. Patient Use

Patients interacting with Medikanic-powered bots do so voluntarily by initiating a conversation. All conversations are facilitated on behalf of the clinic the patient is contacting — Medikanic acts as a technology intermediary only.

Patients should not submit sensitive medical information beyond what is requested during the intake flow. Medikanic is not responsible for medical decisions made by clinics based on information collected through the platform.

5. WhatsApp & Meta Platform Compliance

Our service operates via the WhatsApp Business API. Use of our platform is subject to Meta's Platform Terms and WhatsApp's Business Policy. We reserve the right to suspend service if a clinic's usage violates Meta's policies in a way that puts our platform account at risk.

6. Intellectual Property

All software, designs, workflows, and content created by Medikanic remain the intellectual property of Medikanic. Clinics are granted a limited, non-exclusive license to use the platform during their subscription period.

Patient data collected through the platform remains the property of the patient and is processed on behalf of the clinic. Medikanic does not claim ownership of any patient data.

7. Limitation of Liability

Medikanic provides its services "as is" without warranties of any kind. To the fullest extent permitted by law, Medikanic shall not be liable for:

Our total liability to any clinic shall not exceed the fees paid by that clinic in the three months preceding the claim.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure issues, or third-party API outages (including WhatsApp/Meta) may cause temporary disruptions. We will make reasonable efforts to notify clients of planned downtime in advance.

9. Termination

Either party may terminate the service agreement with 30 days written notice. Medikanic reserves the right to immediately suspend or terminate access if a clinic violates these terms, engages in fraudulent activity, or uses the platform in a way that causes harm to patients or third parties.

Upon termination, clinic data will be retained for 30 days and then permanently deleted unless otherwise required by law.

10. Governing Law

These terms are governed by the laws of the Republic of Turkey. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of Diyarbakır, Turkey.

11. Changes to These Terms

We may update these terms from time to time. We will notify active clinic clients of material changes via email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
